General sales conditions for shopping online on the website

All items can be bought online using the Luxury Store srl website, of which it is the sole owner.
1) General notes
These General Terms and Conditions ("Terms") are regulated by the Consumer Code (D. Lgs. n. 206/2005) and the rules on electronic commerce (D. Lgs. n. 70/2003).
The Customer ("Customer") is invited to read in accordance with the preferred mode the present General Conditions.
2) Condition of sale to the public
The Products and their prices presented in the Website constitute an offer to the public in accordance with the procedures set out in the General Conditions and in the Website. The conditions of this offer only apply to purchases made on the Website.
All prices include IVA / Monofase Sammarinese tax.
The delivery costs ("Delivery Costs") are charged to the customer has highlighted in the Purchase Order ("Purchase Order").
The prices of products are those shown on the website at the time of confirmation of the order, without any consideration of previous bids or any changes that might occur after.
Purchase Orders must be made online through the order process ("Procedure Order") on the Website.
In order to proceed to the conclusion of the Purchase Order the Customer must provide the requested personal details, needed to make the purchase.
The Client correctly concludes Procedure Order if the Website does not show any error message.
The Purchase Agreement will be concluded at the time of receipt of the Order by Luxury Store srl website.
The receipt of the order will be acknowledged with an e-mail confirming the order ("Order Confirmation") to the email address supplied by the customer. Confirmation to summarize the Product purchased, its price (including delivery costs), the address for delivery, the order number ("Order Number") and the General Conditions of sale.
The Customer undertakes to verify the correctness of the personal details contained in the Order Confirmation and to notify within 24 (twenty four) hours any eventual changes. Any extra charges caused from personal details errors not promptly reported will be charged to the customer.
The Number of the Order, generated by the automated system and notified by email, will be used by the customer in all communications with the site owner.
In the case of the unavailability of certain products, the customer will be promptly notified.
5) Types of Delivery
Goods will be delivered using a delivery service ("Delivery Service") with specialized couriers ("Couriers"), exclusively in the areas specified in the "Shipping and delivery" section.
At the time of delivery the customer is required to be present to check that the packaging is intact and that the products received correspond to those in the Order. In case of visible defects, such as incorrect quantity and / or incorrect product, or broken packaging, the customer must report this on the delivery note and contact the website owner by e-mail no later than 7 (seven ) days from delivery.
6) Costs of Delivery
The delivery costs ("Delivery Costs") are charged to the customer and properly highlighted in the Order.
The customer can get information about the after-sales services, by accessing the "contact" section of the website or by e-mail.
8) Returns & Refunds
The right of return, as provided by law, is intended for the purchase of online articles on the website. The deadline within which to exercise the right of withdrawal is 14 days from receipt of the goods, within which the customer is required to communicate it to the owner of the website, exceeded that date, return request cannot be considered valid. The right of withdrawal is however subject to the following conditions:
The law applies to single products purchased in their entirety;
the product/s purchased must be returned intact and in original packaging, complete in all its parts (including packaging and all accompanying documents);
delivery costs for returning the product are charged to the customer;
restitution is under the full responsibility of the customer;
personalized items are excluded from the right of withdrawal;
If the right of return has been correctly completed, the website owner will refund the customer the full amount paid, inclusive of delivery costs, within thirty (30) calendar days of receipt of notice of return. The amount will be refunded after expenses for the Restitution of the Products, which will be borne by the customer.
a) Legal guarantee for the Consumer
The consumer, as defined in art. 3 of the Consumer Code ("Consumer Code" D. Lgs. n. 6 September 2005, n. 206), has the right to seek legal guarantee provided by the Consumer Code itself in Articles 128-132.
This warranty provides, also, that the consumer, under penalty of forfeiture, informs the website owner the possible lack of conformity encountered by the consumer in the product purchased within 2 (two) months from the discovery (Art. 132, Code of Consumption).
Following this communication, the consumer will be entitled to ask repair or replacement of the product, without prejudice to any other rights provided by law in favor of the consumer.
The legal warranty above is valid for a maximum period of 2 (two) years from the product delivery. After this period, the website owner will not be liable for conformity defects encountered by the consumer.
In the case of replacement or repair of the Product, the terms of the warranty on the product as a replacement, or resulting from repair, it is the same as the original product. Therefore, the total two-year legal warranty begins from the original product delivery.
Reference is made, in any case, for the discipline of the legal guarantee, the rules of the Consumer Code referred to in Articles 128 and following.
b) Legal Guarantee for Customers not Consumers
The customer is not consumer, as defined in art. 3 of the Consumer Code, has the right to seek legal warranty provided for in the Civil Code.
This warranty provides, also, that the Customer not Consumer, under penalty of forfeiture, communicate any lack of conformity found in the product purchased within 8 (eight) days of discovery.
The Legal guarantee above is valid for a maximum period of 12 (twelve) months from delivery of the Product. After this period, the website owner will not be held liable for lack of conformity identified by the Client Consumer.
For Warranty validity we recommend you to show the delivery document.
For any communication you can contact the website owner through a special e-mail box
Any disputes concerning the interpretation or execution of this contract shall be resolved exclusively by the appropriate court, without prejudice to the application of rules of the Consumer Code in the case of purchases by consumers.
SHIPPING AND DELIVERY
Costs of shipping
There are no delivery costs for all orders in the countries of the European Union.
The delivery costs for EXTRA EU countries amounts to 10,00 €
The Cash on Delivery payment costs an extra 5.00 EUR.
Delivery of products
The delivery of the purchased products is done within the Italian National Territory and the Republic of San Marino.
The products will be delivered by Express Courier or by those responsible for it, to the address indicated which can not be changed once the order has been confirmed.
On receiving the parcel the customer must check the integrity of the package containing the product purchased; if there are any discrepancies they must be immediately reported to the Express Courier.
Delivery is carried out within 24/72 hours (72 hours for Calabria and Isole Maggiori).
The products purchased are delivered as quickly as possible, usually within 5/6 working days. The website owner will try to deliver all orders within a maximum of 10 working days from the date of the order, except in cases of unforseen circumstances.
If more than 10 days late, the customer will be contacted directly by e-mail to be informed and updated on the expected delivery date.
The following forms of payment accepted on the website
• COD (cash on delivery directly to the Express Courier, only for Italy and for purchases up to 300,00 €)
• Credit Cards Visa, Mastercard, American Express and Master card through the PayPal system
• Bank transfer in advance (for Italy only)
• Paypal from other Paypal account
Cash on delivery
For cash payment means the payment only by cash directly to the Express Courier at the time of delivery of the goods. The Express Courier is authorized to accept only exact sums, corresponding to the order. In case of high amounts, the website owner reserves the right to request an advance payment of the amount, by bank transfer as a security deposit.
Payments by bank transfer
By selecting this mode you will receive the bank details by e-mail at the time of purchase confirmation.
When paying by bank transfer the goods will be dispatched only after verification that payment has been credited to the current account of our bank.
However it is recommended to send a copy of the bank transfer by e-mail, so to be sure the products will be reserved on your behalf.
The details appearing on the bank transfer must indicate:
• The number of the order
• Name and Surname of the buyer
The bank transfer must be made within 3 days from the date of purchase. If within 5 days after order confirmation is not received the payment, the order will be considered automatically cancelled.
Payments by Credit Card through Paypal circuit
These are the credit cards accepted: Visa, Mastercard, American Express and carta Maestro.
This includes CartaSì, BancoPosta credit card, Postepay, Aura card and all other credit cards that bear the logo Mastercard, Visa or American Express.
The credit card details are managed directly by the Bank.
PayPal is an online payment system that provides for the opening of an account with PayPal.
Concluding a purchase with this payment type will be displayed PayPal page.
You need to enter your email address and password related to your PayPal account.
After registration you can make payments through PayPal without having to re-enter their details, even for subsequent purchases. In case of purchase through the PayPal payment method at the end of the order the customer is directed to the PayPal login page.
The amount of the order is debited from your PayPal account at the time of order.
In case of cancellation by both the Customer and in case of rejection by the website owner, the amount will be refunded to customer's PayPal account.
The cancellation is possible until the order has been processed. The order status is clearly visible in "My Purchases" and can no longer be changed if it shows "Order processed".
At no time during the purchase process the website owner is able to know the customer's financial information. As there is no data transmission, there is no possibility that this data is intercepted.
The website has no archive and therefore does not keep such data.
For every transaction made with your PayPal account you will receive a confirmation email directly from the PayPal system.
Information regarding payment by credit cards for people who DO NOT have a Paypal account.
Even if you do not have a Paypal account, but you have a credit card, you can still pay through the Paypal website:
• select at the moment of the payment the method "Paypal"
• select the link: "continue payment", which is under the text in bold letters: "Do not have a PayPal account?"
•in the next page you can enter details of your credit card and conclude the purchase process.
Security of payments by Credit Card
If paying by credit card or through Paypal circuit your card details is directly managed by the bank that specializes in the management of online payments. The information is encrypted by using 128-bit encryption (SSL) to prevent the use by a third party and are sent directly to the bank.
